I'm moving into a new apartment in 2 weeks. Due to the lockdown with the evolving corona virus situation the building is saying they will not allow me to move in. I have a written and signed contract confirming this move in date, along with paid security deposit etc. What are my rights? Do they need to legally honor the agreement in this time of uncertainty? Thanks, would hate to be homeless.
Does the contract have a force majeure clause? If so, your counterparty may well be within its rights to deny you possession. In any event, you are not likely to be able to get a timely injunction requiring the counterparty to allow you possession. Your best bet may be to request that the contract be terminated with return of your security deposit. If that is unavailing, find a friend who has some floor for you to sleep on until this crisis passes.
