Dog Visitation

My friend is blind and retired her seeing eye dog. She can no longer take care of the dog. She interviewed many people and finally decided on one gentleman who she thought was suitable to take the dog. This man verbally agreed to let her see the dog about twice a year just to take her for a walk or to play. No money was exchanged. This is not just a pet dog and the dog really meant a lot to my friend. The man seems to be going back on his word now and will not let her see the dog. There were no documents written agreeeing to any visitation and we know it was only a verbal agreement. The owner has not registered the dog as his and is demanding something from the institution where the dog was given from. They do not do this. The man seems to becoming more irrational and does not want the dog to be taken away from him. My friend just wants to be able to see her dog at least once a year and is unable to by this man. Is there anything that can be done legally?

last summer rather than go to small claims court i chose mediation......the mediator was rude and verbally abusive. i thought mediation was supposed to help both parties reach an agreement without bias.

I recently let my neighbors newly licensed child drive my automobile. She crashed into my garage by accident and now I have damages to my automobile and garage. Who is financially responsible, myself or the parents of the minor? I did allow this individual to drive with me present, does this make me fully liable?

property damage

Extensive damage occurred to our condo as a result of a large water pressure surge that occurred after the main water supply to the community was turned back on. The pressure surge was large enough to lift the toilet tank cover enough to knock over an aerosol can to the seat cover, break a glass compote bowl that was knocked to floor and then break the shut-off fixture inside the tank. This caused water flowage onto the main level & undiscovered for 3 days. Neither our personal insurance nor the condo insurance companies nor the Board will restore it to it’s original appearance – they will only “patch” it. This is contrary to our condo By-Laws that state that we are entitled to have it restored to its original condition. (The Board has however, agreed that an entire ceramic floor had to be torn up because the pattern could not be matched exactly when ½ of the floor had been damaged.) Both insurance companies are going after the manufacturer to recover their costs stating that the fixture in my toilet tank was defective even though there was an air pocket in the lines when the water was turned back on.

Is the lawyer verbage : ''alternative dispute resolution'' the same process as going through county dispute resolution services offered through the state of California? If they are the same, then I'd like to know why my attorney charged me for him to be there when in fact, noone but the two in the dispute are supposed to be there, along with a mediator. Also, why was there a charge for this private alternative dispute resolution service? And why did the mediator tell me I had no chance of winning my dispute? Isn't it the job of the mediator to help us to come up with an outcome that benefits all?

Lawsuit Settlement

Thank You for answering my question. My father-in-law was injured and his lawyer suggested that he settle before the case went to trial. He did not want to settle, however he listened to what his lawyer suggested and they settled the case on Thursday August 30th.

Is my father-in-law locked into his decision that he made on August 30th, or is there a law that says he has a certain amount of days to change his mind...like a contract when purchasing a car...etc.

watercraft accident on rented vehicle

I was in an accident on a small rented watercraft. I was not offered insurance on the rental nor given any advice on how to operate it. I was told by the rental company that the craft was ''totaled'' without proof of a professional estimate. My credit card was charged for the amount that the rental co. decided on...Am I responsible for the full amount charged to me without any proof of the cost? Is the rental company partly liable for not offering insurance, giving a lesson on how to operate the craft, or for not giving me the option of paying for the damages?
