So I have two people and their one year old son, which I do not mind its his parents that I can't stand, living with me and my family in NYCHA Housing apartment. They were already served papers from housing court from our friend since we cant serve them, by the end of this month they have to leave or else they go to court but the problem is the pandemic of the corona-virus I'm not sure there will be court. They took over our living room and kitchen and we are forced to stay in our rooms and they dirtied up my apartment, I have video and picture proof of how my house looks. Before this whole thing happened they did pay rent for about six month and then stopped because they looked through my fiances mail and saw how much he owed. When we asked for their rent they kept giving us excuses and then the threats came in. We really need to know if the courts will be open because I cannot live with them anymore. They haven't paid in over two years now and the treats keep coming. I really need some good news here
Dear Manhattan NYCHA Tenant:
Did your friend serve the Notice of Petition and Petition? Or, did your friend serve a tenancy termination notice? If your friends lived with you more than one year and not more than two years, you had to provide a 60 day tenancy notification. If your friend served a notice of petition and petition you know you have a future court date. That only lets you know that nothing could occur on the initial court date because the Housing Court is closed.
If you haven't started the court case, I do not believe the Housing Court Clerk is able to accept new petitions for filing and accept index number fees, since no court date could be set when court is not expected to be open.
If management did not provide written permission to have those two rent paying persons live with you, you too risk tenancy termination by NYCHA when court resumes. If you had permission, you provided their income information on your annual certification.
There will not be court. All evictions and warrants of eviction are suspended indefinitely.
