What legal basis do states have for charging different tuition rates for in state and out of state students? isn't this illegal under the Constition under the rights and priviledges clause?

A long time ago the U.S. Supreme Court ruled that it is perfectly acceptable for a state to provide certain services, such as higher education, to its own domiciled residents on a preferential basis by means of lower tuition rates.
