My fiancee has been getting terribly sick and has had go to the Er multiple times each time she has her doctors notes and the general manager had wrote her up for being sick shortened her hours and is trying to write her up for anything she can

Do I have to file with the EEOC or State Agency for discrimination or can I go straight to court?

I was discriminated against at my job and terminated after I complained. I'm trying to find out if I HAVE to file with an agency or if I can go straight to suing them.
